1. Acceptance of Terms of Use
These PENTA Terms of Use apply to your access and use of the PENTA App, PENTA Website, and related services (collectively, the "Services") provided by TRULITE KOREA CO., LTD. (including its affiliates, hereinafter referred to as "PENTA," "us," or "we").
By using the Services, logging in, publishing User Postings, or clicking on a consent button, you agree to these Terms of Use and acknowledge that you have read and understood our Privacy Policy.
If you do not agree, you may not use the Services.
2. Changes to Terms of Use
PENTA may amend these Terms.
Material changes will be notified:
- 7 days prior for general changes
- 30 days prior for disadvantageous changes
- Notice provided via email or in-app notifications.
3. Definitions
- Digital Content → Storybooks and other digitized content.
- PENTA App → Digital reader, storefront applications, websites, and/or software.
- User Postings → Content submitted by users.
4. Ownership and License
- Digital Content remains owned by PENTA or its licensors.
- License is limited, personal, non-commercial, and non-transferable.
- Restrictions: no copying, redistribution, or DRM circumvention.
5. PENTA App Usage
- Use only on authorized devices.
- Some Services require account creation.
- Updates may be provided; refusal may limit functionality.
- No reverse engineering.
6. Conditions of Use
Minimum age: 13 (or local legal minimum).
Acceptable use rules:
- No impersonation
- No hacking
- No excessive load
- No spam
- Must comply with applicable laws.
Content moderation may apply.
7. Privacy
- PENTA respects your privacy (see Privacy Policy).
- Users under 13: parental consent required.
- Third-party login info may be collected by providers.
- Public posts are visible to others.
- PENTA may communicate via email, surveys, etc.
8. User Postings and Feedback
License granted to PENTA for:
- Service improvement
- Marketing
- Feedback assigned to PENTA.
Promotional/marketing use may be global.
9. Advertisements and Third-Party Services
- Ads may be provided by PENTA or third parties.
- Linked third-party services are used at your own risk.
10. Fees and Refunds
- Subscription-based content may require fees.
- Refund policy: Request within 7 days for unused content.
- Fees may increase (users will be notified in advance).
- Payments handled by third-party processors (PENTA not liable for processor errors).
11. Termination and Suspension
PENTA may suspend or terminate access for:
- Terms violations
- Maintenance
- Technical reasons
12. Disclaimer of Warranties
Services and Digital Content are provided "as-is," without warranties.
13. Limitation of Liability
- PENTA is not liable for indirect or consequential damages.
- Liability limited to fees actually paid.
14. Indemnification
Users agree to indemnify PENTA against claims arising from:
- Service use
- User Postings
- Violations of these Terms
15. Governing Law and Disputes
- Governed by Korean law.
- Disputes filed at:
- District Court of user residence, or
- Seoul Central District Court (for foreign addresses).
16. Complete Agreement and Severability
- This Agreement is the entire agreement.
- Invalid provisions are severable.
